These Community Guidelines set out the basis on which you may interact with our Community or the website on which we make it available ("our Site"), as a community user ("User"). They apply in addition to our NARS Community Terms.

The NARS Community site at www.community.narscosmetics.co.uk is a site operated by Shiseido UK Limited, the exclusive distributor of the NARS brand in the United Kingdom (“NARS”, "We", “Our”). We are registered in England and Wales under company number 02797273 and have our registered office at Shiseido UK Limited, 6th Floor 1 Kingsway, London WC2B 6AN. We are a limited company.

Please read these Community Guidelines carefully before you start to use our Site. By using our Site, you indicate that you accept these Community Guidelines and that you agree to abide by them. If you do not agree to these Community Guidelines, please do not use our Site or join the Community as a User. Please note that if you do not comply with these Community Guidelines, this may result in us taking action as set out in section 15 of our NARS Community Terms.

Prohibited Uses

You may not use our Site:

a. In any way that breaches any applicable local, national or international law or regulation.

b. In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

c. For the purpose of harming or attempting to harm minors in any way.

d. To bully, insult, intimidate or humiliate any person.

e. To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Community Guidelines.

f. To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

g. To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

h. To upload terrorist content.

Content Standards

We aim to provide you with a safe Community based on inclusiveness and understanding. In order to ensure that all our NARS Community Users feel welcome, Users need to follow our content standards which apply to any and all comments, images, videos or any other material which is generated by Users on our Site, including materials which you post or send on or through the Site ("Contribution") and to any interactive services associated with it.

1. The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.

2. NARS will determine, in its discretion, whether a Contribution breaches the Content Standards.

3. A Contribution must:

a. Be accurate (where it states facts).

b. Be genuinely held (where it states opinions).

c. Comply with the law applicable in England and Wales and in any country from which it is posted.

4. A Contribution must not:

a. Be defamatory of any person.

b. Be obscene, offensive, hateful or inflammatory.

c. Bully, insult, intimidate or humiliate.

d. Promote sexually explicit material.

e. Include child sexual abuse material.

f. Promote violence.

g. Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

h. Infringe any copyright, database right or trade mark of any other person.

i. Be likely to deceive any person.

j. Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

k. Promote any illegal content or activity.

l. Be in contempt of court.

m. Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

n. Be likely to harass, upset, embarrass, alarm or annoy any other person.

o. Impersonate any person or misrepresent your identity or affiliation with any person.

p. Give the impression that the Contribution emanates from NARS, if this is not the case.

q. Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.

r. Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

s. Contain any advertising or promote any services or web links to other sites.

5. For the avoidance of doubt, for any Contribution in the form of video content:

a. You must tell us immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (Restricted Material).

b. You must not upload a video containing harmful material.

c. You must not upload a video containing advertising for any of the following:

1. cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine; or

2. for alcoholic drinks that are not aimed specifically at under 18s and do not encourage immoderate consumption of alcohol.

6. Any advertising included in a video you upload must not:

a. prejudice respect for human dignity;

b. include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;

c. encourage behaviour prejudicial to health or safety;

d. encourage behaviour grossly prejudicial to the protection of the environment;

e. cause physical, mental or moral detriment to persons under the age of 18;

f. directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;

g. directly encourage such persons to persuade their parents or others to purchase or rent goods or services;

h. exploit the trust of such persons in parents, teachers or others; or

i. unreasonably show such persons in dangerous situations.

7. You must use the functionality provided on our Site to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.

Rights you are giving us when you upload posts

1. By posting or sending any Content on our Site, you:

a. confirm that you have the right to post the Content on our Site;

b. confirm the Content you post does not infringe any third party intellectual property rights; and

c. you grant NARS a perpetual, irrevocable, worldwide, royalty-free, fully sub-licensable and transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and distribute such Content for any legitimate business reason that we see fit, including for marketing, business development and internal administrative purposes, and/or to incorporate such Content together with your username/name and location into any form, medium or technology, including (but not limited to):

i. on all electronic, IT, digital, multimedia and internet media including our Site or other Shiseido group websites, social media pages and other online presences;

ii. on all advertising media both online and offline;

iii. on internal NARS communications within the Shiseido group;

iv. for corporate, financial communication and public relations communications and disclosures;

1. on retailer-and client-facing media.
